New York Governor Kathy Hochul signed into law new requirements on the safe use of e-bikes and lithium ion batteries. The legislation requires lithium ion batteries to meet manufacturing and safety standards, includes numerous provisions for resources for state agencies, first responders, and consumers, and requires a red tag on micro-mobility device cords stating the devices should be unplugged when not in use. Noticeably absent from the legislation is a requirement for e-mobility device systems to follow manufacturing and safety standards. PRBA was involved at all stages of the legislation and will continue to provide updates to members on any possible changes. While several portable battery EPR bills were considered during this legislative session, none of the bills had sufficient support to pass the full legislature. PRBA expects significant portable battery EPR legislative activity in New York in 2025.
