New York City’s Department of Consumer and Worker Protection issued on September 15, 2023 a Notice of Public Hearing and Opportunity to Comment on Proposed Rules on Local Law 39. The Law mandates that mobility devices be certified to specific UL safety standards and went into effect on September 17, 2023. The proposal to amend Local Law 39 is very limited in scope and intended to clarify what is considered an “accredited testing laboratory” for purposes of testing to the UL standards as referenced within the law. Because other states (e.g., New York, New Jersey) are expected to consider adopting similar laws on mobility devices, any modifications to Local Law 39 will likely impact what is considered in these other jurisdictions.
