PRBA Files Comments on EPA Proposed Rule to Ban TCE, Issues Report to PRBA Members

On December 15, 2023 PRBA filed comments on the Environmental Protection Agency’s (EPA) proposed risk management rule for trichloroethylene (TCE) under the Toxic Substances Control Act (TSCA) to ban the manufacture (including import), processing, and distribution in commerce of TCE for all uses.  A report on the TCE proposed rule was distributed to PRBA members on November 29, 2023.

TCE is an essential processing aid for producing the separators used in lithium-ion cells. PRBA requested that EPA grant a critical use exemption under TSCA Section 6(g) that is longer than the proposed 10 years. PRBA also urged EPA to reconsider the proposed existing chemical exposure limit (ECEL) of 0.0011 ppm and the alternative of 0.004 ppm for inhalation exposures as an 8-hour time-weighted average (8-hr. TWA), because these limits are so low that they would be functionally equal to a ban.
